About the Application

The Texas General Land Office, the entity responsible for administering the Community Development Block Grant Mitigation (CDBG-MIT) Program, is now accepting applications for Hurricane Harvey State Mitigation Competition funding. In partnership with Wharton County, the Houston-Galveston Area Council (H-GAC) will submit an application for CDGB-MIT funds no later than October 28, 2020.

As specified in the Texas General Land Office CDBG-MIT Competition Application Guide, H-GAC is posting information about this application for a 14-day public comment period. H-GAC is following a detailed citizen participation plan that provides for and encourages citizen participation at all stages of the program.

About the Project

Following Hurricane Harvey, a consortium of communities concerned with flooding in the lower portion of the Lower Colorado River initiated a project to enhance flood modeling and plan for installing flood gauges along the system to provide real-time flood data to decision-makers. The Lower Colorado River and San Bernard River Flood Warning System project will build on that effort by replicating the modeling on the adjacent San Bernard River and Caney Creek systems and installing flood gauges throughout the project area.

If funded, this project will allow for enhanced hydrologic modeling for the San Bernard River and the installation of new flood gauges and upgrades to existing gauges along the lower Colorado River, San Bernard River, and Caney Creek. This effort will provide inundation maps and real-time flood data to decision-makers and Office of Emergency Management professionals to better predict and react to flooding events and mitigate future impacts on life and property in eight counties, including six within the H-GAC region.

Project Scope of Work

The following summary scope of work describes the range of activities that may be undertaken with the Community Development Block Grant-Mitigation Funds requested for this project.

  1. Project Delivery - The Houston-Galveston Area Council (H-GAC) will be responsible for the overall delivery of the project, including financial management, compliance, coordination of project partner efforts, and other activities necessary to successfully fulfill project objectives and fiscal responsibilities.

  2. Enhanced Flood Models and Mapping - Wharton County will engage its previously procured engineering consultant (Consultant) to enhance existing flood models for the San Bernard River, conduct bridge surveys, and produce updated inundation maps for the San Bernard and Caney Creek watershed portions of the Project Area. This work will build upon and complement modeling and mapping work that has been performed in the Lower Colorado River watershed within the Project Area. This activity will result in more accurate flood prediction information, tied to real-time data from an expanded network of twelve (12) new flood gauges and nine (9) upgraded flood gauges. The proposed locations of these gauges are shown in the Project Area Map.

  3. Acquire and Install New/Upgraded Flood Gauges - H-GAC will be responsible for the procurement of the new flood gauges and components necessary to upgrade the existing flood gauges. Wharton County and its Consultant will be responsible for negotiating an agreement with the LCRA, or other appropriate entity, for gauge installation, and acquiring all necessary permits, easements or other site access permissions. Wharton County and its Consultant will also be responsible for negotiating an agreement with the LCRA or a successor agency to take ownership of the gauges and provide for their ongoing operation and maintenance.

Anticipated Time Frame of Key Activities

  1. First Year - The work to be completed the first year includes initiation of the project; completion of the bridge surveys; development of the updated modeling for the San Bernard River and Caney Creek; and installing five (5) flood gauges on the Colorado River.

  2. Second Year - The work to be completed the second year includes completion of all inundation map galleries; installation and upgrades of the remaining flood gauges.

Budget and Sources of Funding

The total project budget will not exceed $5.4 million over a two-year period. This project will be funded entirely by Community Development Block Grant-Mitigation Funds.

Beneficiaries

The benefits of this project will encompass the entire project area. Within the project area, 44.85% of the population are considered low-to-moderate income. Accordingly, an estimated $2,384,052 of CDBG-MIT funds will be used for activities that benefit persons of low-to-moderate income.

Displacement

The CDBG-MIT activities proposed in this effort will not result in residential displacement. As such, an anti-displacement and relocation plan is not required for this submission.

Public Comment Period

The public comment period closed October 26, 2020, at noon.

Complaint Procedures

Complaints and grievances from the public related to this project will be answered in writing, within fifteen (15) business days of the receipt of the complaint, according to the Hurricane Harvey Mitigation Program citizen complaint procedures.

Complaints will be researched and investigated by H-GAC staff and responded to accordingly.

Complaints regarding fraud, waste, or abuse of government funds will be forwarded to the HUD OIG Fraud Hotline (phone: 800-347-3735 or email: hotline@hudoig.gov).

Documentation for complaints will be maintained digitally. Each file will include contact information for the complainant, the initial complaint, the property address, any communications to and from the complainant, results of the investigation, together with any notes, letters or other investigative documentation, the date of the complaint or appeal was closed, and any other actions taken.

Technical Assistance

When requested, H-GAC shall provide technical assistance to groups representative of low- and moderate-income persons in developing proposals for the use of CDBG-MIT funds, as applicable. The level and type of assistance shall be determined based upon the specific needs of the community’s residents.

Post-Funding Citizen Participation

In the event that this project receives funding from the CDBG-MIT program, the following citizen participation requirements will be met.

  • H-GAC will hold a public hearing any time a substantial change in use of CDBG-MIT funds from one eligible activity to another is proposed. *
  • H-GAC will hold a public hearing and review its program performance, including the actual use of CDBG-MIT funds.
  • H-GAC will retain documentation of all hearing notice(s), attendance lists, minutes of the hearing(s), and any other records concerning the actual use of funds. H-GAC’s Record Retention Policy will language that complies with this statement:

    “HUD regulations generally require your community to retain all its grant-related documentation for 3 years from the date HUD closes its related grant to the state of Texas. As the state grant remains open, the GLO will notify your office once it has closed.”

* In light of the ongoing COVID-19 pandemic, H-GAC may elect to provide for alternative methods of receiving public comment in keeping with city, state, and federal recommendations for public health and safety.
