The TCEQ requires municipal solid waste facility owners or operators to post a complete copy of any application that requires public notice on a publicly accessible website. This requirement applies to applications declared administratively complete on or after March 27, 2006, but does not apply to authorizations at Type IAE and Type IVAE landfill facilities.
In 1993, the Texas Legislature passed House Bill (HB) 2537, which required Councils of Governments (COGs) to develop an inventory of closed municipal solid waste landfills for their regional solid waste management plans. The bill was in response to concerns and incidents involving public health and safety when development occurred over property once used for waste disposal.
Landfill siting ordinances are land use tools counties can use to determine the appropriate location of landfills within county borders. Three counties in the region have landfill siting ordinances.
